These Terms & Conditions (“Terms”) govern your use of shop.thefiltery.com and any purchases you make from The Filtery (“The Filtery,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return & Refund Policy (collectively, the “Policies”). If you do not agree, please do not use the Site.

Note: These shop-specific Terms apply to purchases on shop.thefiltery.com. Your use of our editorial site thefiltery.com remains subject to its Terms & Conditions.

1) Changes to Terms

We may update these Terms at any time. Changes take effect when posted on the Site with an updated “Effective Date.” Your continued use after changes means you accept the revised Terms.

2) Eligibility; Your Account

You must be at least 18 to purchase. You’re responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use.

3) Orders, Acceptance & Availability

• All orders are offers to purchase and are subject to our acceptance and availability.
  
  

• We may refuse or cancel any order for any reason (e.g., suspected fraud, inventory limits, violations of these Terms). If we cancel, we’ll refund any amounts charged.
  
  

• Quantities may be limited; we may limit or prohibit orders that, in our judgment, appear to be placed by resellers.
  
  

4) Pre-Orders

From time to time we offer pre-sale/pre-order gift boxes. By placing a pre-order you acknowledge:

• Your payment method may be authorized/charged at order time.
  
  

• Estimated ship windows are listed on product pages and may change due to supplier or carrier delays.
  
  

• If a listed item becomes unavailable, we may substitute a comparable item of equal or greater retail value within the same theme. We will note any material substitutions on the product page or in your order confirmation.
  
  

5) Product Descriptions, Ingredients & Variations

We strive for accuracy, but we do not warrant that product descriptions, colors, sizes, or other content are error-free. For curated boxes:

• Contents, scents/flavors, and packaging may vary slightly; sizes are listed on product pages.
  
  

• Full ingredient and allergen information for applicable products is provided on product pages or via a clearly linked Ingredients & Allergen Information page prior to purchase.
  
  

• Always read and follow label instructions and cautions upon receipt (e.g., “For external use only,” “Avoid eye contact,” “Keep out of reach of children and pets”).
  
  

6) Pricing, Taxes & Promotions

• Prices are shown in U.S. dollars and may change without notice. We reserve the right to correct pricing errors.
  
  

• Applicable sales taxes are calculated at checkout based on your shipping address.
  
  

• Promotions/discount codes may have additional terms and can’t be retroactively applied or combined unless expressly stated.

• Gift cards may be excluded from certain promotions or discounts unless explicitly stated.

7) Payments

We accept the payment methods shown at checkout (e.g., major credit cards, Shop Pay, etc.). By submitting a payment, you represent that you are authorized to use the selected method and authorize us (and our payment processor) to charge the full order amount, including taxes, shipping, and any applicable fees.

8) Shipping, Risk of Loss & Delivery

Shipping options, costs, and estimated timelines are shown at checkout and further outlined in our Shipping Policy.

• Risk of loss passes to you when we deliver the order to the carrier.
  
  

• Delivery dates are estimates and not guarantees; carrier delays and weather or other events may affect delivery.
  
  

• Certain products (e.g., fragrance items) may ship via specific services per carrier requirements. We comply with all carrier guidelines and will choose an appropriate service for safe delivery, including to AK/HI when permitted.
  
  

9) Returns, Refunds & Damages

As explained in our Return & Refund Policy:

• Due to the seasonal and curated nature of our gift boxes, all sales are final.
  
  

• If an item arrives damaged or incorrect, contact us within 7 days of delivery with your order number and photos; we’ll replace the item or issue a refund where appropriate.
  
  

• We are not responsible for lost or stolen packages after delivery to the carrier, but we’ll help you work with the carrier when possible.

• Gift cards are final sale and not eligible for return or refund (except where required by law).
  
  

10) Personal Use Only

Products purchased from the Shop are for personal, non-commercial use and not for resale.

11) Intellectual Property

All content on the Site—including text, designs, logos, images, product photos, and other materials—is owned by The Filtery or its licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No other rights are granted.

12) User Content & Feedback

If you submit reviews, photos, messages, or other content, you represent you have the right to do so and grant The Filtery a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content in any media for business purposes, subject to our Privacy Policy.

13) Prohibited Conduct

You agree not to: (a) violate any law; (b) interfere with Site operations; (c) upload malware; (d) scrape or harvest data; (e) use the Site to advertise or solicit without permission; or (f) attempt to circumvent security features.

14) Third-Party Services & Links

We may link to third-party sites and use third-party services (e.g., payment processors, analytics, advertising). We are not responsible for their content or practices. Your use of those services is governed by their terms and privacy policies.

15) Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free, or that any defects will be corrected.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE FILTERY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE/USE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

(Some states do not allow certain limitations; in those states, this limitation applies to the fullest extent permitted.)

17) Indemnification

You agree to defend, indemnify, and hold harmless The Filtery and its affiliates from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.

18) DMCA Notice

If you believe content on the Site infringes your copyright, send a notice to support@thefiltery.com with the information required by the DMCA. We may remove content in our discretion and/or as required by law.

19) Governing Law; Dispute Resolution; Class Action Waiver

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. Any dispute will be resolved by binding arbitration in Ohio before a single arbitrator, under the rules of a recognized arbitration organization.
Class Action Waiver. You may bring claims only on an individual basis; class, consolidated, or representative actions are not permitted.
If any part of this Section is found unenforceable, that part will be severed and the remainder enforced; if the class-action waiver is unenforceable, this entire Section is void and disputes will be resolved in court.

20) Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, supply shortages, carrier delays, or governmental actions.

21) Severability; Entire Agreement

If any provision is found invalid or unenforceable, it will be severed and the remainder will remain in force. These Terms, together with the Policies, constitute the entire agreement between you and The Filtery regarding the Shop.

22) Gift Cards

Issuance & Redemption. The Filtery gift cards (“Gift Cards”) are issued and sold by The Filtery and are redeemable only for eligible merchandise on shop.thefiltery.com. Gift Cards cannot be redeemed on third-party sites or for cash, except where required by law.

Delivery. Unless otherwise stated, Gift Cards are electronic (e-gift cards) delivered by email. We are not responsible for delays or non-delivery due to inaccurate recipient information, spam filters, or email client issues. We may delay fulfillment or cancel Gift Cards pending fraud review.

No Fees / No Expiration. Gift Cards have no fees and do not expire.

Final Sale. Gift Cards are final sale and non-refundable, non-returnable, and not for resale. Gift Cards may not be used to purchase other gift cards.

Lost, Stolen, or Unauthorized Use. Treat Gift Cards like cash. Title and risk of loss pass to the purchaser/recipient upon electronic transmission. We are not responsible for lost, stolen, or unauthorized use of any Gift Card. Replacement is at our discretion and may require proof of purchase and remaining balance.

Balance & Split Tender. If a purchase exceeds the Gift Card balance, the remainder must be paid with another accepted payment method. Refunds for orders paid with a Gift Card will be issued back to the same Gift Card (and then to any secondary tender, if applicable), subject to our Return & Refund Policy.

Promotional Gift Cards. From time to time we may issue promotional or bonus gift cards/codes with additional terms (e.g., limited-time usage, minimum purchase). Those terms will govern in case of conflict.

Fraud. We reserve the right to refuse, cancel, or suspend Gift Cards and/or orders where we suspect fraud, abuse, or violation of these Terms.

Cash-Out Where Required by Law. Gift Cards are not redeemable for cash except where required by applicable law. Some U.S. states require cash redemption of small remaining balances; if you are eligible, contact hello@thefiltery.com with your Gift Card number and billing address to request a balance cash-out pursuant to your state’s law.
